Talents Terms & Conditions
I, acting as a聽TRIPSST! Talent, AGREE聽to the following condition(s):聽
1) That TRIPSST! is allowed to publish and use my pictures, copyrighted content (from now on referring to photos, videos, and other media), and my stories, on its various digital channels, such as social media, posts, videos, projects, and websites, as they will help both mine and other travel initiatives.
2) That my copyrighted content and/or stories may be published in any of the TRIPSST! digital channels without restriction, as long as it was created while I acted as a TRIPSST! Talent.
3)聽that I will not receive payment or any other form of compensation for the use of my copyrighted content and/or stories by TRIPSST!.
4) That by placing my name on its Talent List, TRIPSST! will feature, promote, and use reasonable efforts to procure business opportunities for me as an Influencer, or in other phases as a travel content creator, vlogger, blogger, YouTuber, photographer, TikToker or social media star, as well as advising me with respect to my projects at my request.
5) That TRIPSST! is my non-exclusive agent in order to find, for me, business opportunities (to be defined in this Agreement as the performance of services, in the form of a media kit, acting like a travel content creator, talent, and/or social media star).
6) That TRIPSST! has, currently, Agreements that are the same, or similar as this one, in effect with other Influencers and Talents in the community.
7) That TRIPSST! will, during the term of this Agreement, enter into additional such Agreements as it considers.
8) That TRIPSST! will provide and furnish to other persons the same or similar services as TRIPSST! provides me under the terms of this Agreement.
9) That TRIPSST! acknowledges and understands that I may procure business opportunities for myself through third parties (to be defined in this Agreement as external sources different from TRIPSST!), on which TRIPSST! shall not be entitled to any fee, except in those cases when the business opportunity is procured by TRIPSST! for me (accompanied by a previous notification, as well as an Agreement particular to each business opportunity).
10) That I am not, nor shall I be, deemed for any purpose to be an employee of TRIPSST!, and therefore will be forever considered, solely and exclusively, as an independent contractor.
11) That TRIPSST! shall not be liable or responsible for any injury or damage suffered by me while I am performing business opportunities, whether obtained directly or indirectly, by or through TRIPSST!.
12) That TRIPSST! will not maintain any liability, worker鈥檚 compensation, unemployment, or any other form and/or type of insurance coverage for or upon me.
13) That I am solely responsible for any and all risks of performing business opportunities under this Agreement.
14) That I hold TRIPSST! harmless of and from any and all claims, demands, damages, costs and expenses, of any and every kind, which may arise or may be claimed against TRIPSST! from my performance of services under this Agreement.
15) That I have read and accepted all the terms and conditions disclosed in this Agreement.
